The NAFTA Trader provisions allow American and Mexican citizens who conduct substantial trade between Canada, the USA and/or Mexico to obtain work permits to develop and direct those businesses. These provisions can be used for new businesses, as well as for existing ones, and allow much flexibility. As such, they are some of the most useful provisions available to American and Mexican businesspeople.

To apply for a work permit as a NAFTA Trader:

  • The applicant must be an American or Mexican citizen;
  • The Canadian enterprise must have majority ownership by Americans or Mexicans;
  • The enterprise is engaged in substantial trade in goods or services; and
  • The trade is principally between Canada, the USA, and Mexico;
  • The position is supervisory or executive, or involves essential skills; and
  • The applicant must be coming to Canada solely for the purpose of developing and directing the Canadian business.

Some applicants may have the choice of proceeding as a NAFTA Trader or a NAFTA Investor. The choice will depend upon the nature of your business, and your individual objectives. These cases are usually processed very quickly.
